Purpose
These terms govern the showcase website creation services and associated services offered by Ahmed OMEROVIC, a sole trader operating under the trading name MegaMind Studio. They apply to any order for a service, unless otherwise agreed in writing.
Services offered
MegaMind Studio offers the creation of showcase websites in the form of standardised packages (landing page, professional website, bilingual website), as well as a monthly technical management option.
Ordering services
Website creation packages are ordered through the Fiverr platform. A prior exchange on Fiverr makes it possible to confirm the scope of the project (pages, features, content, languages) before ordering.
Pricing
Packages are displayed in US dollars (USD). The prices shown on the site are indicative; the final amount is confirmed on Fiverr. The monthly technical management option is billed separately, outside Fiverr, in euros, at €30 / month.
Payment
Payment for the packages is made via Fiverr, according to the platform's terms. Payment for the monthly technical management option is made by bank invoice / bank transfer via Shine, or by PayPal on request.
Monthly technical management option
The technical management option is a monthly service billed outside Fiverr, at €30 / month. It covers technical management and support tasks (for example: deployment management, domain / DNS configuration, HTTPS / SSL, basic monitoring, small fixes, minor updates, support). This option does not automatically include the domain name, paid hosting, professional email or external subscriptions, which remain the client's responsibility unless specifically agreed in writing.
Delivery timelines
Delivery timelines are indicated for each package and confirmed on Fiverr. They start once the necessary items have been received (content, access, approvals) and according to the platform's terms.
Client obligations
The client undertakes to provide the items necessary to carry out the service: text, images, logo, access to tools, legal information, and domain / DNS access if needed. Meeting the timelines depends in particular on the timely delivery of these items.
Revisions and changes
The number of revisions included is specified for each package. Any request beyond the agreed scope may be subject to a quote or an adjustment, confirmed before being carried out.
External fees not included
The domain name, paid hosting, professional email, external tools, third-party subscriptions and overages related to external services are not included in the packages, unless specifically agreed in writing. These fees remain the client's responsibility.
Delivery
The service is considered delivered when the website, within the agreed scope, is made available to the client and / or put online according to what is included in the package.
Right of withdrawal
In accordance with the applicable regulations, the right of withdrawal may not apply to services that are fully performed or personalised at the client's request. Orders placed via Fiverr are moreover subject to the platform's terms and policy.
Termination of the monthly option
The monthly technical management option may be terminated by either party. The terms and any notice period are specified at the time of subscription. Unless otherwise agreed, the month already started remains due.
Liability
MegaMind Studio undertakes to carry out the services with care and professionalism, as a best-efforts obligation. MegaMind Studio cannot be held responsible for interruptions, malfunctions or damage related to external services (host, domain, third-party tools) or to improper use by the client.
Intellectual property
Unless otherwise agreed, the client holds the usage rights to the delivered website once the service has been paid for in full. Content provided by the client remains its property. MegaMind Studio's know-how and reusable technical components remain the property of MegaMind Studio. Third-party technologies, libraries and content remain subject to their respective licences.
Personal data
The processing of personal data is described in the website's Privacy policy.
Disputes and applicable law
These terms are governed by French law. In the event of a dispute, the parties will endeavour to reach an amicable solution before any action; failing that, the French courts shall have jurisdiction, subject to the mandatory rules applicable to consumers. Services ordered via Fiverr are also subject to the platform's terms.
